ESPN has severed ties with Donovan McNabb and Eric Davis after a month-long investigation into sexual harassment allegations at the NFL Network, an ESPN spokesman confirmed to PFT.

McNabb appeared on the network and co-hosted a weekend NFL show on ESPN Radio. Davis co-hosted an ESPN L.A. Radio show.

On Dec. 12, ESPN suspended the two former NFL players after a lawsuit by a former NFL Network employee named them. Jami Cantor, a wardrobe stylist, accused McNabb of sending inappropriate text messages and Davis of rubbing his body against her and making lewd comments.

The NFL Network suspended former players Marshall Faulk, Ike Taylor and Heath Evans pending an investigation into the allegations made against them by Cantor.

Former NFL Network executive producer Eric Weinberger was suspended by the Bill Simmons Media Group, where Weinberger serves as president.

I wonder what happened with this. Faulk and all of the other guys that were accused don't work at the NFL Network or ESPN anymore. I guess it doesn't matter if it's true.

from: No one is coming back after NFL Network scandal

August 2, 2018

After being accused of sexual harassment, Hall of Famer Marshall Faulk is expected to part ways with NFL Network soon, The Post has learned.

Sources said Ike Taylor and Heath Evans also will not return as analysts on the network’s broadcast this fall. The trio was suspended late last year after a woman brought a wrongful termination suit against NFL Enterprises.

Taylor is already gone, while representatives for Faulk and Evans are finishing up the language of their exits. Faulk’s contract had at least one more year on it.

One clause in the deals, sources said, will prevent either side from suing the other.

The way sexual harassment law works, if an employer has a policy that expressly prohibits harassment and provides a mechanism for employees to come forward, a "safe harbor" of sorts is created. If the employer investigates allegations of harassment and takes prompt and effective remedial action, it is typically shielded from liability (some exceptions would be situations where the harassment involved a tort, such as battery, or culminated in the harassed employee's termination). As a result, it does not surprise me that the accused employees (Taylor, Evans, etc.) were terminated. Employers will often fire the accused where there is corroboration of the allegations (even if only in part), as termination of the harasser is the most effective remedial measure an employer can take.

I won't comment on whether this is fair or not, as I represent both employers and employees and can tell you that the equities vary from case to case. However, in this instance, I'm not at all surprised by the NFL Network's response.

Because it's not harassment if you welcome it!
